REBUTTAL: SOME OBAMA BIRTH RECORDS MADE PUBLIC FOR YEARS By Lynn Stuter April 26, 2011 NewsWithViews.com In an article published on various websites, Mark Niesse of the Associated Press, has made various claims regarding Barack Hussein Obama's birth records. As always with such stories <http://hosted.ap.org/dynamic/stories/U/US_OBAMA_BIRTH_CERTIFICATE?SITE=NCAG W&SECTION=HOME&TEMPLATE=DEFAULT> , Niesse has carefully avoided the deeper issues and the real issues regarding Obama's eligibility to the office of president. First of all, Niesse claims that if you go into the Department of Health, Hawaii, and look in a binder readily available to any member of the public, you will find, there among the "O's," annotation of the birth of Barack Hussein Obama. This binder is a computer print-out; computer print-outs are the result of data files; and data files are easily changed, easily added. Is it mere coincidence that when John Charlton requested copies <http://www.thepostemail.com/2010/02/26/okubo-responds-to-public-outcry-for- investigation/> of that same index, received by him in January 2010, Barack Hussein Obama's name did not appear in that same index under the "O's"? Obviously, Niesse chose to take what was in that binder at face value. But there is more to the document in that binder than meets the eye. While Niesse claims this binder contains "birth" information, that is not true. In an interview, published in the Star Advertiser <http://www.staradvertiser.com/news/breaking/114401004.html> , January 21, 2011, the infamous doubt-talking Janice Okubo said, The index is just to say who has their records within the department. That's an indication . I can't talk about anyone's records. In other words, this binder is really merely an indication that the Department of Health, Hawaii, holds "records" on Barack Hussein Obama; what those records are, is anyone's guess. Given the myriad of different ways in which birth certificates can be obtained in Hawaii, even for foreign-born children, this binder is no indication that what Department of Health, Hawaii, holds in "their records" is a Hawaiian long-for birth certificate or anything that indicates Obama was born in Hawaii; merely that "records" exist for Barack Hussein Obama at the Department of Health. As Okubo makes clear, what those records are will not be disclosed. Niesse further proclaims, with regard to The Donald's "investigation" of Obama birth documents, What the would-be sleuths won't find is Obama's "long-form birth certificate," a confidential one-page document containing his original birth records kept on file in the first floor of the Department of Health. First of all, since Niesse hasn't seen that document, it is purely conjecture on his part that it even exists. As Janice Okubo made clear, what records Department of Health, Hawaii, holds for Obama is purely speculative. Again, Niesse takes the matter at face value. If he stood before a judge, in a court of law, and said, "Judge, I know that document exists because the Department of Health, Hawaii, has indicated they hold records on Obama," the judge would tell him that unless he could produce said document, that his claim of its existence was purely conjecture. The same is true of Niesse's contention that Obama was born in Hawaii. Bear in mind, that when AKA ran for the Senate, from the great state of Illinois, back in 2004, an article appeared in the Sunday Standard in Kenya proclaiming, "Kenyan-born Obama all set for US Senate <http://classic-web.archive.org/web/20040627142700/eastandard.net/headlines/ news26060403.htm> ." It is of note, that when the scrubbing bubbles began to 'sanitize' internet sites of articles that would in any way implicate that Obama was not born on American soil, that this article disappeared. It didn't, however, disappear from the web archives. One of those inconvenient truths that also plagues the question of where Obama was born is the words of his own wife, Michelle Obama, who, before live audiences, has proclaimed no less than twice - here <http://www.youtube.com/watch?v=xx3-MGHFXkc> and here <http://www.youtube.com/watch?v=bpgfrgBg8QU> - that her man was born in Kenya. Niesse further contends that Chiyome Fukino, who served as the head of the Department of Health under former governor Linda Lingle, stated that "she's convinced the long-form document is authentic" in reference to press releases published in late 2008 <http://hawaii.gov/health/about/pr/2008/08-93.pdf> and mid-2009 <http://hawaii.gov/health/about/pr/2009/09-063.pdf> . But if you read those carefully lawyered press releases, it becomes obvious, very readily, that such is not what she has stated; that those press releases are carefully worded to lead people to conclusions that are not stated outright; they are deliberately insinuative. An individual who worked for the State of Hawaii, during the 2008 election cycle, states categorically, that no birth records exist at the Department of Health, Hawaii, for Barack Hussein Obama. In fact, he provided a sworn declaration <http://www.scribd.com/doc/47511068/Sworn-Affidavit-by-Former-Hawaii-Senior- Elections-Clerk-Tim-Adams-No-Obama-Long-Form-Hospital-Generated-Birth-Certif icate-on-File-1-20-2011> to that effect; a very legal document. Niesse further states, in his article, "Only one-third of Republicans said they believe the president is native born." Native born and natural born are not the same. And the term natural born is what is stated in Article II, Section 1, Clause 5, United States Constitution. Native born does not require two parents who are citizens, natural born does. If Obama was born on American soil, he may be native born, but because his father was a British subject at the time of his birth, he is not natural born. This brings us to the crux of the whole matter of Obama's eligibility to the office of president. Obama, himself, has admitted that he is not natural born; claiming that, at birth, he held dual citizenship <http://www.factcheck.org/askfactcheck/does_barack_obama_have_kenyan_citizen ship.html> . Natural born, as defined by Vattel's Law of Nations <http://www.lonang.com/exlibris/vattel/vatt-119.htm> requires two American parents born on American soil. This is the definition used by the Founding Fathers. Those who claim that natural born has never been defined, do so for the purposes of obfuscating the issue. It was Thomas Jefferson, 1823, who stated, On every question of construction, carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it conform to the probable one in which it was passed. Niesse closes out his article by referencing the birth announcements published in Hawaii newspapers at the time of Obama's birth. He then admits that the address used in those birth announcements was not the address of the Obama's but rather that of her parents, Stanley Armour and Madelyn Lee (Payne) Dunham. Niesse seems to think these birth announcements are definitive proof that Obama was born in Hawaii. Not so. In 1961, birth announcements could be placed by anyone and the address used in these birth announcements suggests several possibilities, not the least of which is that the Dunham's placed the birth announcement because Stanley Ann Dunham Obama was nowhere around. We know that on August 19, 1961 she was living in Seattle, Washington <http://www.wnd.com/index.php?fa=PAGE.view&pageId=106258> , registered to attend the University of Washington. She would not return to Hawaii until the supposed father of her child had left the island to attend Cambridge in Massachusetts. Niesse does not address the fact that the hospital at which Obama now claims he was born, Kapi'olani Maternity and Gynecological Hospital, refuses to authenticate that he was, indeed, born there. In his article, Niesse also claims that a copy of the long-form birth certificate would not be issued to anyone, not even Obama. However, Niesse carefully skirts the fact that this was not always the case. I don't know how old Niesse might be, but most of us older folk have our long-form birth certificates. As does Obama, who admitted, on page 26 of his book, Dreams from My Father (2004, paperback), that he found his birth certificate, among other documents, at the home of his grandparents in Hawaii. This, of course, begs the question of why not simply produce it as John McCain produced his; why the whole charade with the altered/forged Certification of Live Birth or COLB. What Niesse did not cover in his article is questions surrounding the adoption of Barack Hussein Obama by Lolo Soetoro, the evidence pointing to that adoption, and the lack of legal documents changing Barry Soetoro's name back to Barack Hussein Obama. Nor does Niesse's article touch on the Indonesian citizenship of Barry Soetoro with no legal documents evident that he was ever eligible to, or did, reclaim American citizenship. For all Niesse knows, Barack Hussein Obama is still a citizen of Indonesia. Why is any of this important? If Barack Hussein Obama is not natural born (and he is not by his own admission), he is not eligible to the office he holds. This means he is an imposer and any bill signed into law by him, including Obamacare, is null and void. All the money that was stolen from the American people to bail out the Wall Street tycoons, to keep them in their cushy lifestyles, null and void, constituting felony theft of taxpayer funds. All the money spent, that has increased the national debt by $3.7 trillion under Obama, also felony theft of taxpayer funds. The pro-Obama forces scream "birther" any time anyone brings the subject of Obama's eligibility up. Funny thing, that. These people obviously believe that if they tromp all over the Constitution, they won't pay for it in the long-run. They delude themselves. The Constitution means nothing if it is not carefully and consistently guarded. Those who want verification of Obama's eligibility do so because it is in the best interests of America. It is their right, their duty. Anyone who thinks that is to be made fun of, laughed at, denigrated without any real proof that Obama is eligible to the office he holds, and there has been no proof presented, are not more than blood-sucking leaches out to destroy what our United States Constitution stands for, the great country it established, and the great country they have reaped the benefit of. In essence, they cut off their noses to spite their faces. They should try living under the "democracy" they seem to think the United States is; they would discover, very quickly, that the rights they had under the United States Constitution should be cherished as should the constitutional republic with rule of law the United States Constitution established. And what none of them really want to talk about is the article <http://www.dailykos.com/story/2008/06/12/534894/-The-Bombshell-on-McCains-B irth-Certificate> that appeared on the Daily Kos, on June 12, 2008, about the eligibility of John McCain to the office of president. Interestingly, that article makes the same claims about the eligibility of John McCain to the office of president as have been made about the eligibility of Barack Hussein Obama to the office of president. The Daily Kos, of course, has been one of the champions of calling those who demand evidence of Obama's eligibility, "birthers". Amazing how things change. And the only difference between the two is that John McCain produced his long-form birth certificate. And while Barack Hussein Obama has admitted he also has his long-form birth certificate, he has not produced it. And while the lamestream media splattered the McCain accusations all over the e-waves, they carefully concealed and denied the same accusations about Barack Hussein Obama. It is interesting that the Daily Kos article, questioning McCain's eligibility, appeared on the same day the digital files show the document Obama claims is his "birth certificate", but that is actually a COLB, was altered/forged. If Obama has nothing to hide, he would have produced his long-form birth certificate, the one he has admitted that he has, long ago instead of spending over $1 million to keep it concealed. The American people have a right to know. Every member of the United States Congress, assembled, has the duty, the responsibility, under the oath of office each one of them took to protect and defend the United States Constitution, to investigate this matter. That they have refused to do so - for fear of adverse lamestream media publicity; because Barack Hussein Obama claims to be black; because people voted for Barack Hussein Obama; because they fear riots in the street if the truth is known - is an act of treason against the American people, the American republic, and the United States Constitution. It's long past time that the American people demand a return to the tenets of the United States Constitution. There is no better place to start.
