9/11 terror suspects finally charged by U.S. military commission

"This case keeps dragging on and on as a result of the Obama
Administration's insistence that Khalid Sheikh Mohammed and the four other
terrorists be tried in a civilian federal court in downtown New York City.
The original Department of Justice announcement of civilian trials was met
with a huge firestorm and the President and Attorney General [Eric] Holder
backed down and allowed the 5 men to be tried by the U.S. Military," said
former NYPD detective and military intelligence officer Mike Snopes.

 

Guantanamo Bay detainees Khalid Sheikh Mohammed, Muhammad Salih Mubarak Bin
'Attash, Ramzi Binalshibh, Ali Abdul Aziz Ali, and Mustafa Ahmed Adam al
Hawsawi were formerly charged today by the office of military commissions
prosecuting attorneys for their roles in the September 11, 2001 terrorist
attacks. 

 

The prosecutors recommended that the charges against all five suspects be
classifed as capital or death penalty case.  Capital charges may only be
pursued with the military authority's approval.  Under the rules governing
military commissions, the alleged terrorists will have the right to counsel
who are experienced in trying capital cases. 

 

The charges allege that the five accused were responsible for the planning
and execution of the attacks on New York, Washington D.C. and Shanksville,
Pennsylvania, on September 11, 2001.  Those terrorist attacks resulted in
the deaths of nearly 3,000 people.

"At first, Obama asked Attorney General Eric Holder Jr. to choose the site
for the trial of [Khalid Sheik] Mohammed. But swift and intense criticism
greeted [Holder's] decision to try the self-proclaimed mastermind of the
attack and his four alleged co-conspirators in a civilian courtroom in New
York," said Snopes..

 

The key signatory of a letter urging Obama and his Attorney General Eric
Holder to stick to their proverbial guns was Senator Patrick Leahy, the
chairman of the U.S. Senate's powerful Judiciary Committee.

 

"Our system of justice is strong enough to prosecute the people who have
attacked us," said the Senator known to many in the law enforcement and
intelligence communities as "Leaky" Leahy.

 

The charges are allegations that the suspects committed offenses that are
chargeable under the Military Commissions Act of 2009.  There are eight
charges common to all five of the suspected al-Qaeda terrorists: conspiracy,
murder in violation of the law of war, attacking civilians, attacking
civilian objects, intentionally causing serious bodily injury, destruction
of property in violation of the law of war, hijacking aircraft, and
terrorism.

As with civilian trials held in federal and states' courts, the accused are
presumed innocent and may be convicted only if their guilt is proven beyond
a reasonable doubt. 

 

These charges go beyond what is necessary to establish that the 9/11
co-conspirators may be lawfully detained under the 2001 Authorization for
Use of Military Force, according to the the Department of Defense press
statement. 

 

In accordance with the Military Commissions Act of 2009, the sworn charges
will be forwarded to the Convening Authority, Bruce MacDonald.  The
convening authority will then make an independent determination as to
whether to refer some, all, or none of the charges for trial by military
commission. 

 

If the convening authority decides to refer the case to trial, he will
designate commission panel members -- the jurors.  The chief trial judge of
the Military Commissions Trial Judiciary would then assign a military judge
to the case.
