A friend in her early thirties was about to try to start a family. In the
course of a full medical to make sure she was in A1 health, a malignancy
was discovered. She had a hysterectomy a few days later.
Now a year along, she and her husband would like to have a baby with a
surrogate. Her ovaries are intact so the baby would be conceived using her
ovum and her husband's sperm. They have been put in contact with a
surrogate mum in Canberra, have met her and are very happy with her.
Having consulted a Brisbane barrister, they are afraid of litigation. Even
if they move to Canberra, at some time later could their child be taken
away, declared to be not their's, or could they be charged with procuring a
baby, etc. etc., if they later move back to Brisbane.
Is there anyone on the list who has some knowledge and/or experience in
such matters who could assist my friend?
