Distribution of condmgr.dll is positively recommended because it was not
provided on earlier (pre-3.0) conduits.
I'm not totally sure of the precise legal issues, but these kinds of DLL's
are very rarely covered by any kind of distribution restriction, provided
you don't represent that you own it.
3Com provide it free to anyone who asks for it!.
