There's an excellent body of law in the USA supporting the 
concept of a "Trade Secret", but in order for it to apply, you have
to make a determined attempt to keep your trade secret a secret.
Therefore when Aaron published his code, even with the disclaimer,
it ceased to be secret. I'd advise Aaron to change to another set
of legal text ASAP.
