The US government doesn't think it's silly. They believe that, by preventing the export of encryption algorithms, they are saving themselves from terrorism and crime. I'm not a lawyer specializing in export law, but I believe that the US export restrictions apply to items made in the US, not to items made outside of the US. However, if the software that runs on the device is exported from the US to some outside country, then US export restrictions apply to that software. So, if what you really want to know is whether or not a Japanese branded Palm OS device contains EncDES in the ROM, I don't know, but it probably does not. You could easily get a Japanese ROM and test it.
