I'm NOT a lawyer, but I can tell you that, in most states here in the
U.S., possessing this sort of device can be illegal depending on the
motivation of the person possessing it or the result of it's use. These
devices are defined as 'hoax devices.'
It is typically illegal if:
* You intend to commit an act of terrorism
* You intend to intimidate the civilian population
* You intend to influence the conduct or activities of the
government of the United States, a state or locality through
intimidation
* You intend to compel the emergency evacuation of any place of
assembly, building or other structure or any means of mass
transportation
* You place any person in reasonable apprehension of bodily harm
The possession of a hoax device is a Class 6 felony in many states and
is typically punishable by imprisonment for one to five years or jail
for up to 12 months and a fine of up to $2500
