 This reminds me of a thread I saw in Slashdot recently about 
"abandonware": computer software which is no longer available.  It applied 
mostly to old games.

 Some people are freely distributing copies of them, which is technically 
illegal (which is why the copyright holders aren't too pleased about it) but 
there's no other way to get them as the copyright owners are not making 
them available for sale or even free download, so the public misses out and 
legally speaking they can't do anything about it.
