I guess the cop gets to define it at first. I think the jury would
ultimately make the determination.
If the cop wanted to be a jerk then that picture someone put up a few
weeks
ago (Stenquist maybe?) of the girls with the ice cream cones could be
deemed
to be improper.

And in the meantime, a chill is put on an entire group of people on the
offchance someone sees their camera, and calls the cops.
I would be very afraid to take a camera out of my house at all if I lived in
Texas.
