So was "Shadowlands," admittedly by a movie, but perhaps that was still the reason.


You can register the same trademark as someone else as long as it's not
for competing (or nearly competing) products.

It sometimes depends on the value of the original trademark. The trademark "Jaws" from the movie was so valuable that the courts disallowed Sears from trademarking the name Jaws for a trash compactor.
