When it gets to the point that any speech or action considered anti-government is punishable, the USA will just be a capitalist version of the USSR.

The government can now break laws at will (blatantly), spy on it's own citizens (blatantly), detain prisoners without charging them (blatantly), deny access to a fair trial (blatantly). All with the justification of protecting it's citizens.

I thought these were things the 'USA' was *against* just a few years ago.

It's only a false dichotomy when taken out of context. You left out my supporting argument. That renders your critique of the argument fallacious.
