I certainly would recommend against moving or touching a nest, but I would certainly try to get a shot. I wouldn't hesitate to use flash, if it's the best way to get the shot. I've found that birds don't seem to react to flash. A noise will immediately frighten them away, but I've gotten repeated shots of resting birds with flash.
