If someone doesn't want their picture taken don't take it. Their reason is unimportant. It's called "common courtesy." It's unimportant if they are the main subject in a photo or part of the crowd or background, regardless of legality.
In this specific case, you know that Muslims are against having the photo taken on religious grounds, so why even attempt such a thing, and why complain about it here.
