So long as a work is deemed as original it has automatic copyright
protection (in the US (Berne Convention Implementation Act 1989) and
many other countries). Registration of copyright or declaration of
copyright in print on the article may make your job or a lawyers job
easier but having no indication of copyright doesn't mean it wouldn't
be copyright material.
