You can publish any picture taken in a public place in an editorial context or gallery. You can't use it to promote a product or service without a model release. Sometimes I approach the subjects, tell them I've taken a photo and ask if they'd like me to send them a copy. This time I chose not to. I rarely ask for a model release on the spot, but I usually have one handy. The legalese in the release is frightening to most. However, if I think I have something of real value, I will ask for a release. I have secured a few, including one for the portrait of the African American man whose pic is on the opening page of the Pentax Gallery.
