I can see Bill's point. When I'm not manually focusing, I almost always
select the focus point myself, no that's not correct, I /always/ select
the focus point myself, (I don't trust no flinking algorithms). Being
able to do that reliably seems to be much more important than being able
to select a different function from the multi-function menu, while
shooting...

I might be mis-understanding the problem but I seem to recall some
discussion on this a month or so ago. According to this post from
Mark,
the 4 way controller can be set to provide access to functions or as a
focus point selector (via a custom setting?? - I don't know).
Anyway here's the relevant post:

Something got changed between the cameras at GFM and the production
firmware. The camera does not behave as per that post.
That K-7 with 0.something firmware I checked at Pentax Day already
operated as your 1.0 camera does about the 4-way controller, hence I
believe the folks at GFM just didn't realize what they had to check.
However, there will be a firmware update very soon, fixing the mess.

dammit, we need to send smarter people to GFM.
I've been shooting with this camera almost every day for the last
month and I have yet to see this as an issue worth getting upset
about. In Sel mode you push the OK button and use the D-pad to move
the focus points. Very simple. Any deviation from that has been due to
my own fumble fingers or more likely my wandering off from the task at
hand.
I won't disagree with what Bill experienced; the camera does do that
(except maybe for reverting to default for spite) but I think I've
just become accustomed to hitting the OK button after I've been doing
something other than moving the focus point, and I agree that a custom
option that locks in the D-pad when you turn the indicator to SEL
would be a good thing, in practice I've just not seen it as that big a
deal.
Maybe my big deal threshold is higher. I dunno. Or maybe some other
things have been more of an annoyance *to me*, like how fiddly it is
to remove the SD card, or that the camera seems to default to the
highest ISO in the auto range.
I'm not sure on that last point, It's just a feeling I have, and I
don't have a manual yet to look it up. Maybe Bill could look it up for
me.
