My point Maris, is that by making an arbitrary decision, the
pissant little American judge (yes, I have strong feelings on
this one) is ignoring the laws of other nations.
I find it ludicrous, and quite offensive, that an American court
feels it has the right to say that it is OK to break the laws of
other countries, and then make it incumbent on the citizen of
the other country to bring the case to the USA to have it tried.
American courts, and government have a long history of ignoring
agreements that it is signatory to, and the laws of other
countries, when it is inconvenient to abide by said laws and
agreements.
At least that is what I am seeing with the myriad trade disputes
that are ongoing between our two countries, where the US has
consistently ignored GATT and NAFTA rulings when it is
inconvenient to abide by the agreements that the American
government is signatory to.
I could go on, but I won't.
Is an American court going to feel that, based on Mr. Pissant
9th circuit court judge's decision that a foriegn law needs to
be considered?
I suspect not.
What that decision is saying is that it is OK for an American to
steal intellectual property from someone in another country, not
withstanding the fact that copyright laws in the country where
the owner is located, and the server that the images reside on
is located.

Interestingly enough, it was this particular court decision that
made it possible for Lycos to contravene the copyrights of PUG
contributors.
More intersting still, it was mostly American contributors who
had their shit in a knot about the violation of their
intellectual property rights.
