I've also come across information saying that if you can't find the original 
copyright holder, you can use orphan works rules stating that you don't have 
copyright and the original holder is unknown, and be prepared to remove (say 
from a website, the image identified as an orphan work), if the copyright 
holder comes forward.

Then there is another piece which says that if you can't find the copyright 
holder, you must assume permission isn't granted.

So there you go, what could be more straight forward.

I think the rules for "orphan works" are different in the UK & the US, with the US rules being the more restrictive.
