Pursuant to this > mandate, EMSA conducted its first inspection of the Philippines' compliance > with the procedures for education, training, and certification of seafarers > in accordance with the STCW Convention in 2006 and submitted its findings to > the Philippine government on deficiencies in our systems. In 2009 they > conducted their second inspection to see our level of compliance on the 2006 > findings. They submitted their second report on deficiencies in April, 2010. > The deadline for compliance with the findings in the second report is August > 31, 2011. A summary of deficiencies identified in the April, 2010 report > includes: > 1. matters relating to the functioning of the maritime administration, > 2. insufficient quality procedures, > 3. insufficient monitoring of schools, > 4. inaccurate approval and review of courses, > 5. the level and quality of training, > 6. the poor quality of inspection of the METIs, and > 7. insufficient qualifications of instructors and assessors. > The assessment was based on a comparison between the initial deficiencies > identified in 2006 and findings upon second inspection in 2009. > The assessment results in Annex 1 of the report involve the functioning of > the maritime administration. The findings on maritime administration, certification > requirements, and programs and courses include: > 1. failure to carry out required audits, > 2. procedural lapses in implementing regulatory requirements for the regular > review of courses and introducing amendments, > 3. failure to implement on board training programs and document on board > training in an on board training record book, > 4. procedural lapses in the validation of the training record book, > 5. inconsistency in the implementation of the management level courses with > the requirements of the STCW Convention, > 6. failure to rectify items omitted in the syllabi for the management level > courses compared with the requirements of the STCW Convention, > Specific findings with respect to the schools include: > 1. failure to set targets for quality objectives in order to measure > achievement of such objectives > 2. failure to identify competency requirements for lecturers and instructors > posts > 3. failure to meet requirements for training equipment as provided in the > STCW and other relevant codes > 4. incomplete description of scenarios for simulator courses to allow for the > proper conduct of exercises and the achievement of training objectives > 5.absence of manuals for simulator exercises and lack of training objectives > for the simulator training > 6. lack of familiarity of trainers with the simulator exercises > 7. failure to record, test and validate simulator exercises to check whether > learning objectives and performance criteria are met > 8. incomplete, missing, insufficient or non-functioning training and > simulator equipment > 9. failure to properly implement the quality standards systems, establish an > audit plan, perform the required audits, and address and correct deficiencies > identified > 10. failure to implement identified five-year development plan > Assessment and report of compliance is now being prepared by the Maritime > Training Council. > The findings are of two kinds: > 1. procedural in nature with respect to the requirement of undertaking > regular audits and implementing the quality standard systems > 2. substantive in nature with respect to compliance with STCW requirements. > Acceptance of corrective measures taken by the EMSA is critical to the > continued recognition of the STCW certificates of Filipino seafarers. There > is a danger of a snowball effect if the EU succeeds in its process to > withdraw recognition of the STCW certificates issued by the Philippines > because other States may take the same action.
