You give technical explanations of the issue, and there are plenty of those around. And regarding your paper, the fact that an OS upgrade does not require a password is irrelevant here because upgrading the software would not remove the encryption. And if the disk were not encrypted an OS update would not be required. But what I'm interested in is analysis of the issues at hand in terms of personal privacy/security vs law enforcement.
