Unfortunately, it doesn't look like it is included in the free Resource Kit tools, http://www.microsoft.com/windows2000/techinfo/reskit/tools/default.asp.
But if you have a version of the Windows NT Resource Kit, you can install supplement 4 which should update your robocopy to 1.95.

I swear I downloaded supplement 4 from somewhere on the Microsoft websites(s) without having to purchase anything (the installation program checks your system for an older version of the resource kit before it will upgrade), but I can't seem to find the location again (that was over a year ago).
If you have an older version of the resource kit, can you use scopy to preserve the permissions?

I was working on a script that makes use of the RoboCopy utility. The
