Recovering the data (assuming the disk isn't corrupted or damaged, and it doesn't sound like it would be) is usually pretty trivial. You can pick up a 2.5" hard disk caddy for under £10 (you'd have to find out if the drive is IDE or SATA, but if it's old then it's probably IDE), which you then just plug into another PC (the replacement laptop?) and copy the files off. (I'm pretty sure we have some caddies on the shelf here, I can check if you want.) For most laptops, the hard drive comes out very easily - one or two screws at most (most laptops consider the hard disk user replaceable).
The old laptop will have some value to someone on ebay, even with the problems you describe.
