Will Section 230 cover Generative AI?

I'm being asked frequently now whether I think Section 230 will (or can, or
should) cover Generative AI. Keeping in mind that 230 is already under
attack from both sides of the political spectrum, my sense is that GAI
protection under 230 will likely ultimately be limited, perhaps extremely so.
It seems to me that the fundamental problem is pretty basic. No matter
how many disclaimers firms put on these systems, we know that most users
won't read them or really understand them. Most users are already
convinced that they're "super search engines", and treating sometimes
totally fabricated and false information from them as accurate. Legal
actions are now appearing related to false accusations of criminal
activity, false legal citations, and the list goes on.

Whether one likes it or not, I suspect there will be bipartisan moves
around the world to hold GAI firms largely responsible for the content
generated by those systems, in manners very different from the traditional
protections that 230 has provided up to now. -L
