You are right, this is a bug, and it is known to me (even though I failed to find the root cause so far). The problem is related to so-called "cell pictures". A workaround is to write "cell picture=true" right after "set layers" -- but that disables some of the effects of the layered graphics (namely layering between different axes within the same tikzpicture). I will look into it with new motivation given your email.
