The patch doesn't work for me. I still have these random errors with 
"open_basedir restriction in effect....."

linux 2.4.7
apache 1.3.26
php 4.2.3 with patch applied

It happens at all servers ( named-based, ip-based, with or without
open_basedir option set)

php compiled with
./configure --with-apache=/usr/local/src/apache
--with-pgsql=/usr/local/pgsql --enable-track-vars
--with-mysql=/usr/local/mysql --enable-magic-quotes --enable-ftp
--with-openssl=/usr/local/ssle
