This bug has been fixed in CVS. In case this was a PHP problem, snapshots of the sources are packaged every three hours; this change will be in the next snapshot. If the 2nd argument is not set it works. When creating domelement not from the domdocument-object with $element = new domelement("Arg1","Arg2") it works.
