No, look closely! It's not an empty "condition" attribute, it is an empty 
"replace" attribute! This one should work in any version...

Interestingly, that's what I ran into yesterday. Found out that while one 
version of phptal hides any content inside the empty condition, another 
(probably older) version would instead show it, causing a rather embarrassing 
few minutes ;)
