It's pretty confusing since i found this one journal session in congress, when Rep. Victoria Hernandez Reyes sponsorship remarks on the proposed OMB budget. "Rep. Zamora next inquired whether the mandate and jurisdiction of the OMB also include the buying and selling of software protected by specific copy-right laws contained in digital data discs. Rep. Reyes replied in the affirmative. She also affirmed that open-source operating systems con-tained in discs that are clearly non-copyrighted sources of data and information are EXCLUDED from the jurisdiction of the OMB. Thus, she pointed out that if the OMB were to raid business establishments containing these discs, it would have to make a dis-tinction between discs that contain software or data covered by copyright laws and discs from open-source operating systems." http://www.congress.gov.ph/legis/print_journal.php?congress=13&id=30 It is clearly there that she affirms that OMB does not have jurisdiction with disc that contains open-source operating systems or softwares?. What is this a flaw in legal system? i wish the Opensource bill that was filed have included the ammendment of this Optical media act, to put an excluding circumstances remarks that Open-Source softwares are not covered by the Optical media act. For the further protection and promotion of FOSS.
