i don't know how the guts of ext3 works, but it is possible that the inode 
unlinking hadn't made it to the disk driver yet.  when you look at your 
copy, the directory is gone?  if the file system had activity, your inode 
could have already been reallocated so that is why it is active.  a find 
-inum will show where it is in the copied filesystem.
