Complain to the owners of the email server being used by the spammer.
If they won't listen, complain to the upstream ISP of the owners of
that server. Most ISP's everywhere in the world generally consider
unsolicited commercial email to be a violation of their acceptable
usage policies, and most of them take such complaints with the utmost
seriousness (I know we do) and will usually act as quickly and
expeditiously as they can to deal with the problem (I know we try).
More so in your case as it's already causing you an effective DoS.
