Strange that for something as significant (I suppose) as this,
you will not find anything about it on NTC web site, nor
will you find there the "Memorandum Circular" [below] that
I assume represents the draft guidelines.
If you do not attend and give your comments/suggestions,
I assume that the below will become the Law of the Land,
and everyone will either have to pay and comply...or
more likely ignore/ridicule it and have to put up with
it as a national embarrassment, at the usual cost to the
national psyche.

MEMORANDUM CIRCULAR No. ___
SUBJECT: WIRELESS LAN AND CONSUMER RF DEVICE
Pursuant to Act No. 3846 (Radio Control Law), Executive Order No. 546
series of 1979 and in order to facilitate the deployment and
development of wireless internet and wireless local area network (LAN)
the following guidelines are hereby promulgated.
Section 1 SCOPE
1.1 This memorandum circular shall cover all wireless local area
network and consumer RF equipment/devices/stations.
Sec. 2 DEFINITION OF TERMS
The following definitions shall apply within the context of this
Memorandum Circular.
2.1 Wireless Local Area Network (WLAN) - network of computers and
other computing devices within 2-kilometer radius utilizing radio
frequencies.
2.2 Consumer RF Device - consumer devices utilizing radio frequencies.
2.3 Spread Spectrum Technology - radio communications technology
utilizing either direct sequence or frequency hopping technique.
2.4 Indoor Equipment - radio equipment with effective range or
coverage within building premises or within 150-meter radius.
2.5 Outdoor Equipment - radio equipment with effective range or
coverage greater than indoor equipment.
2.6 Wireless Personal Access Network (WPAN) - network of computers and
other computing devices within 10-meter radius utilizing radio
frequencies.
2.7 Commission - the National Telecomunications Commission.
Sec. 3 LIMITATIONS
3.1 The effective radiated power (ERP) of wireless local area network
(WLAN) devices shall not exceed 1 watt.
3.2 For consumer RF (CRF) devices and wireless personal access
network, the effective radiated power shall not exceed 50 milliwatts.
3.3 Only WLAN, WPAN and CRF devices that are duly type approved or
type accepted by the Commission can be sold and used.
3.4 WLAN, WPAN and CRF devices shall operate within the bands
allocated by the Commission.
3.5 WLAN, WPAN and CRF devices shall strictly operate on a
non-interference basis (NIB).
Sec. 4 REGISTRATION AND LICENSING
4.1 Indoor equipment shall be registered.
4.2 Duly registered indoor equipment shall bear registry code issued
by the Commission for proper identification.
4.3 Outdoor equipment shall be covered by appropriate permits and
licenses required under existing rules and regulations.
4.4 Equipment or radio stations used by public telecommunications
entities (PTE) to offer duly authorized telecommunications services,
e.g. hotspots, access points, etc. shall be covered by appropriate
permits and licenses under existing rules and regulations.
4.5 Indoor equipment used by the subscribers of PTEs shall be duly
registered.
Sec. 5 FEES AND CHARGES
5.1 The registration fee for each indoor equipment shall be PhP500.00
for WLAN devices and PhP100.00 for WPAN and CRF devices.
5.2 Each outdoor equipment shall pay appropriate permit and radio
station license fees pursuant to existing schedule of fees and
charges.
5.3 In addition, spectrum user fees of PhP0.05 per KHz for each
outdoor equipment and equipment used by PTEs to offer duly authorized
services shall be paid.
Sec. 6. OPERATION OF SPREAD SPECTRUM TECHNOLOGY DEVICES WITHIN THE
2400MHz -- 2483.5MHz BAND
6.1 The suspension on the filing, acceptance and processing of
applications for various permits and licenses and demonstration
purposes of radio equipment using spread spectrum technology (SST)
within the band 2400MHz -- 2483.5MHz in the areas of National Capital
Region, Region III and Region IV is lifted.
Sec. 7 DEALERS AND SUPPLIERS
7.1 Duly authorized dealers and suppliers of WLAN, WPAN and/or CRF
devices shall only sell and carry on stock duly registered indoor
equipment.
7.2 Outdoor equipment shall only be sold to persons or entities with
duly approved permit to purchase.
7.3 Registered dealers and suppliers shall comply with existing rules
and regulations, among others, on sales and stock reporting and permit
to import.
Sec. 8 ADMINISTRATIVE SANCTIONS
8.1 Violations of any of the provisions of this circular shall be
dealt with in accordance with law.
8.2 The following fines shall be imposed:
8.2.1 Selling of unregistered indoor equipment - PhP5,000.00 per unit
or station with forfeiture of equipment
8.2.2 Selling of outdoor equipment to persons or entities without
valid permit purchase - PhP5,000.00 per unit or station with
forfeiture of equipment
8.2.3 Illegally acquired indoor and outdoor equipment - PhP5,000.00
per unit or station with forfeiture of equipment
8.2.4 Non-submission of monthly Sales and Stock Report - PhP1,000.00
per month
Sec. 9 REPEALING CLAUSE
9.1 Any circular, memorandum, order or parts thereof inconsistent with
the provision of this circular shall be deemed amended or superseded
accordingly.
Sec. 10 EFFECTIVITY
10.1 This circular shall take effect fifteen (15) days after
publication in a newspaper of general circulation and three (3)
certified true copies furnished the UP Law Center.
