Many Thanks for the pointer found it way down the hierarchy, brought a copy to /usr/local/bin and now get the following error from the slimserver log
2005-12-11 12:46:44.0377 cannot connect to http daemon to get playlist at /Library/PreferencePanes/SlimServer.prefPane/Contents/server/Slim/Utils/Scan.pm line 436. Not really clear as to the problem here prior to this there are loads of lines adding programs that appear as entries on the Slimserver menu display.
