Ok, let's assume this LAYER NAME "river_lowres" GROUP "river" MAXSCALE 50000
LAYER NAME "river_highres" GROUP "river" MINSCALE 50000 both have the legend displayed in case of legStyle "attached". You can skip the legend for 1 of them using the METADATA tag "SKIPLEGEND" "2". If you use legStyle "swap" then always just the legend of the layer visible at the current scale should be displayed when swapping to legend view. Note however that attribute search is just working on a single layer, not a group.
