With the standard layout, you need to add those lines just before
"PM.Layout.resizeContainers();":
/** Tabs */
$('#uiLayoutEast').pmTabs(PM.tocTabs); // Tabs for TOC/legend swap
$('#toc, #toclegend').top(30); // make some space for tabs
