Correct. GDAL 1.9 works fine as long as the table has a rid column.
rtpostgis_legacy.sql is not needed.
gdalinfo PG":host=localhost dbname='test' user='USERNAME'
password='PASSWORD' table='aspect' mode=2"
The above command works for me with GDAL 1.9 and GDAL trunk.
