I'd say the kernel is right and your battery is just getting old - my notebook is not even 6 months old and look at this:
design capacity: 55080 mWh last full capacity: 47552 mWh So I lost quite a bit (>10%) of capacity already...btw, what's the physics behind the "trick" with the uncharged battery put in a cold enviroment and then loaded again? I wonder if I could boost up my capacity a bit as well...
