There is stray static everywhere, (rubber conveyor belts, metal detection grids, handling by machine and people, being transported by aircraft, etc. ) I've seen everything from individual I.C.s to RAM modules to Motherboards arrive DOA when shipped without special covering.
My question would be : Did the shipper specify that they would ship in an anti-static covering or guarantee a non-DOA MB? If not, you really don't have a leg to stand on legally. "Let the buyer beware". I definately would never purchase from that person again, (After giving them the chance to make good first.) but that doesn't help with the expensive lesson learned. I hope that it wasn't a LEM Swap List deal. If it was via eBay, you may have recourse through them.
