I work with a practice that is concerned about collecting past due self-pay balances from patients that are moving or requesting their records be transferred to a new provider. One option they are considering is (with exceptions related to urgency of treament, etc.), holding records until self-pay balances are paid. My concern is, with the Right to Access, is it legal for this practice to "hold" a transfer of the patient's record until outstanding balances are addressed?
