Do we have to have silly Mac PC debates? These are the bane of too many lists on the Internet.
This isn't a Mac / PC debate

Hi - it seemed to be going that way - which is why the comment...

Surely there must be a good Apple repair techie out there? Or are
those that know keeping his existence a secret?:-)

There are but some are better at certain areas than others.

In the UK, is there not a simple consumer law defining 'not of merchantable
quality'?

The Sale of Goods Act and the Sale and Supply of Goods Acts both cover this area.

Goods have to be of merchantable quality. They must be working when you get them.
In the past I have had a couple of Dead on Arrival Macs and the company who supplied them replaced them.

If things go wrong within a year they are covered by the basic warranty. If you buy extended warranties - then you are covered on the "original item" but often not if it gets replaced and the replacement goes wrong.

I believe the law states that a supplier must offer goods fit to do what they say. If they don't they're deemed of 'not merchantable quality' and you can either get a replacement or a refund.
If Apple are saying 'call your lawyer', in the UK, maybe you should....

In the case of the Bowater's computer it obviously is faulty and should be replaced as it is a pup.
It is sad to see Apple behave like this - they have been blind to some faults with the G5.
There was one I had with a faulty video card - but armed with some technical knowledge and some searching on Apple's Support boards I found it was a common fault. The answer there was to ring Tech Support in India with the solution rather than the problem.

If Apple continue to be obstinate, then there is always the Small Claims Court, a lawyer or even newspapers and their consumer complaints pages.

Whatever happens don't give up and hope that next time your Mac is as good as it should be!
