When using VSS a "snapshot" of the system is taken at the time when the backup 
is initiated and the snapshot is the one that is backed up not the live data, 
hence no file locks as the live data is never locked. 

This may point the way, unless you are using the perpetual backup (mirroring) 
which I think is an option in the latest product.

It was MozyPro. The problem seemed to be with files in the 'waiting for
backup' queue.
