Yes. But he could use the name of the calculated field in an having clause !

 SELECT  ;
    IIF(EMPTY(natno) OR ninoconfirm = .f.,.t.,.F.) as choose, ;
    natno, ;
    ninoconfirm , ;
    surname ;
    FROM  calcpay!employee ;
    HAVING choose ;
    ORDER BY  refn DESC ;
    INTO CURSOR Empinfo READWRITE
