And the criminal would have robbed someone else or killed someone else.  Better 
the criminal is dead than to prey on the innocent some more.

The police did not tell him not to follow the kid, the 911 operator did and 
that isn't the same thing. 

However, he did initiate the confrontation as, had he returned home when asked 
to do so, we wouldn't be having this discussion.
