It's a very unfortunate and deplorable situation. The schools are not
funded to hire qualified teachers, by educational background or
temperament. These people should never have been in a classroom in the
first place. Moreover, funding to individual schools is in part
dependent on capitation, they get more money if they can handle more
students within their current staffing limits. It's seen as
'productivity.'  Students in disability programs are prized because
they bring in additional funding through entitlement programs.

The Unions, therefore, find themselves in an impossible situation:
defend members who are unqualified in the first place (The Unions
don't decide on the qualifications, the schools do) or start doing the
job of administration that the schools themselves are incapable of
doing. Remember that the teacher in question has been certified fit to
teach by the school and numerous time through supervisory observation.
(These personnel are not teachers and not represented by the teacher
unions). Imagine what would happen if, as a defense, the teacher in
question argued that she was being singled out for punishment when the
remaining staff were not subject to the same scrutiny. Neither the
union nor the school system will ever allow this to happen.  .... so
there's much more for this parent to be irate about than the teachers
and aides who were directly involved.

He should sue. If enough parents did this, it would eventually become
cheaper to fix this problem rather than bury it, which is what would
be accomplished if this teacher were successfully scapegoated.
