That is the problem have with that proposed law is that it should be driver of the car's responsibility not hit anyone no matter if they paying attention or not. It is reckless driving not negligence walking! My wife and I commute through some rural areas and one time came upon a deer in the road in my lane. I was so surprised that my wife was telling me to hit it instead of going into the other lane (there were only 2 lanes)! Fortunately, there was no on coming traffic and I was able to swerve around the deer who finally got out of the road. I am glad I didn't have to hit anything! David L.
