There was a push to make "losers pay".  If you bring a lawsuit and you lose, 
you had to pay the defendant's legal bills.

Well if a small guy is suing a large company, the large company may have 
$500/hr lawyers and the small guy may have a $100/hr lawyer.  The large company 
can keep the lawsuit tied up for years, racking up huge legal costs.  

So clearly "losers pay" doesn't work.

The problem is that some people think a misdiagnosis or a medical error is 
equivalent to winning the lottery.  The doctor messed up and I lost the tip of 
my little finger, so now I sue for $50 million for pain and suffering.

So clearly we have to come up with some tort reform or this will never work.
