Menurut anggota Komisioner Bidang Agama dan Budaya KPAI, Asrorun Niam Sholeh, sikap keenam sekolah Kristen tersebut jelas telah melanggar UU Sistem Pendidikan Nasional No 20 Pasal 12 Tahun 2003.Menurutnya hak agama dan mendapatkan pendidikan agama adalah amanah konstitusi. Ia menambahkan setiap sekolah yang mengabaikan aturan pendidikan tersebut jelas harus ditertibkan. “Kan sudah jelas bunyi aturannya bahwa setiap peserta didik pada setiap satuan pendidikan berhak mendapatkan pendidikan agama sesuai dengan agama yang dianutnya dan diajarkan oleh pendidik yang seagama,” jelasnya kepada hidayatullah.comdi kantor MUI Pusat, Senin (21/01/2013). Karenanya, Asrorun meminta kepada keenam sekolah Kristen dan Katolik tersebut untuk konsisten. Jika tidak mau menyediakan guru agama Islam seharusnya sekolah tersebut dari awal tidak menerima siswa beragama Islam. “Mereka seharusnya belajar seperti Sekolah Muhammadiyah di NTT yang menyediakan pendidik Kristen dan Katolik bagi siswa yang beragama tersebut itu baru tindakan yang benar,” jelasnya lagi. Keenam sekolah yang dimaksud Asrorun itu sendiri antara lain SMA Katolik Diponegoro, TK Santa Maria, STM Katolik Santa Maria, SD Katolik Santa Maria, SD Katolik Yos Sudarso dan SMP Katolik Yos Sudarso. “Semua sekolah itu ada di Blitar,” jelasnya. Bagi Asrorun, penolakan SMAK Diponegoro Blitar dan beberapa sekolah lain untuk memberikan hak pendidikan Islam bagi siswa beragam Islam adalah melawan konstitusi. Menurutnya lagi, UU Sisdiknas berdasarkan Pasal 7 PP Nomor 55 Tahun 2007 telah memberikan kewenangan kepada Menteri dan Bupati atau Walikota. Kewenangan itu terkait pemberian sanksi administratif berupa peringatan sampai dengan penutupan. “Pemerintah harus tegas menegakkan UU dengan memberikan sanksi bagi sekolah dimaksud,” tambah lelaki yang juga anggota Komisi Fatwa Majelis Ulama Indonesia (MUI) ini.
