Lawyer: Bali Bombers Plan Final Appeal
      06:39 AM EST July 04, 2006
      The Associated Press

      JAKARTA, Indonesia
Three Islamic militants on death row for the 2002 Bali bombings will file
a final appeal against their convictions, their lawyer said Tuesday, a move
that will delay prosecutors' preparations to execute them.

The three men were among more than 30 people convicted in the nightclub
bombings, which officials say were carried by the al-Qaida-linked Jemaah
Islamiyah terror group. The attack killed 202 people, mostly foreign tourists.

After a second round of attacks on Bali last year, the government said it
was looking to speed up the execution dates amid fears the defendants were
still exhorting influence on militants.

The three have already said they would not seek clemency from the
president, a process that can take several years. In April, prosecutors tracked
down their relatives and asked them whether they planned to seek mercy. They
said they did not.

However, lawyer Wirawan Adnan said Tuesday he planned to file a final
appeal - known as a judicial review - to the Supreme Court later this month.

"The prosecutors can execute them whenever they want, but it will be
against the law since the three still have the right to appeal," he told The
Associated Press.

I Wayan Pasek Suarta, a spokesman for the attorney general, said the men
had the right to file an appeal, which would automatically put the executions
on hold.

A judicial review requires lawyers present new evidence to the Supreme
Court. Adnan did not say what evidence he intended to offer. Each of the men
has already admitted to helping plan and carry out the blasts.

Last week, the Justice Ministry gave permission for executions to take
place on Nusakambangan prison island, where they are detained - not on Bali
where they were convicted - leading to speculation that the men may be put to
death soon.

Prosecutors do not reveal the date of executions ahead of time, but word
often leaks out through prison wardens and family members. Prisoners typically
wait five to 10 years on death row before being executed while appeals are
heard and bureaucratic procedures are carried out.
