facts legal procedure spotlight Radoslav Brdjanin was born
on 9 February 1948 in Celinac, Bosnia Herzegovina. Civil engineer by
profession, he worked in the building trade until 1990. At that time, given the
difficulty to maintain the unity of Yugoslavia, certain regions in Bosnia
Herzegovina began to organise themselves into regional structures based on the
concept of Municipality Assemblies such as existed under the 1974 Yugoslavian
Constitution. The Municipalities Assembly of Bosanka and Krajina, based in
Banja Luka, was created in April and May 1991.This Assembly adopted
a Serbian political programme. Radoslav Brdjanin was its first Vice-President
On 25 June 1991, Slovenia and Croatia declared their independence from
Yugoslavia. In Croatia fighting broke out during the summer of 1991 between the
Yugoslav Popular Army (JNA) and the Croatian Armed Forces. With the war
dragging on in Croatia, it became probable that Bosnia Herzegovina would also
declare its independence from the Federal Socialist Republic of Yugoslavia
(FSRY). The Serbian Democratic Party of Bosnia and Herzegovina (SDS) realising
that it could not keep Bosnia Herzegovina within the FSRY, undertook the
creation of a separate Serb entity within Bosnia Herzegovina. In September and
October 1991 the Municipalities Assemblies mentioned above were transformed
into autonomous Serb districts. The Municipalities Assembly of Bosanka Krajina
was transformed into the Autonomous Region of Krajina (ARK)
On 9 January 1992, the Serbian Republic of Bosnia Herzegovina was proclaimed
and re-baptised as the Republika Srpska on 12 August 1992. The leaders of the
SDS felt that the large Muslim and Croatian population, living in the zones
they had claimed as part of the Serb Republic of Bosnia, presented a major
obstacle to the creation of their State. The creation of this State and the
protection of its boundaries therefore implied, in time, the complete
evacuation, or ethnic cleansing, of practically the whole Bosnian Muslim and
Croatian population.
A strategic plan was adopted and set going under the impetus of Radovan
Karadzic. Crises groups were formed to act as organs of coordination and
execution of the main elements of the operational phase of the plan and to take
over the administration of the regions and the municipalities. The ARK Crisis
Staff was set up on 5 May 1992 with Radoslav Brdjanin as its President.
In this capacity, Radoslav Brdjanin played a role of the first order in the
campaign to create a ethnically pure Serb State. His position enabled him to
facilitate the ethnic cleansing by putting all of the instruments of State
power (media, central administration, housing authority, health service,
police, legal system, means of production and employment ) in the hands of the
governing bodies and those persons committed to an ethnically pure Serb State.
It was he who signed the decisions and orders of the Crisis Staff of the ARK,
which in turn instructed and compelled the municipal Crisis Staffs into taking
action. Certain members of these cells participated directly in carrying out
the alleged crimes: persecutions, deportations, murders, torture, destruction.
Radoslav Brdjanin knew or had reason to know that such crimes were being
committed, and failed to take the necessary and reasonable measures to prevent
such acts or punish the perpetrators thereof.
He was arrested by the SFOR on 6 July 1999 and transferred on the same day to
the International Criminal Tribunal for ex-Yugoslavia (ICTY).

ACEH REBEL LEADER CALLS INDONESIAN RULE ABSURD In a rare interview from his
exile in Sweden, the leader of the movement fighting for independence in
Indonesia's northernmost province of Aceh, Hasan di Tiro, says Indonesia has no
right to govern Aceh. The exclusive interview with the FAR EASTERN ECONOMIC
REVIEW appears in its July 29 issue, published Thursday, July 22. The
uncompromising di Tiro calls Indonesia another name for the Dutch East Indies
with new rulers, Javanese instead of Dutch. Di Tiro, who declared Aceh's
independence in 1976 but fled to Sweden three years later, dismisses
Indonesia's new autonomy legislation as irrelevant. The notion of Indonesia is
absurd, he says. He also ridicules the Bahasa Indonesia language as "pidgin
Malay" and calls the Javanese "barbaric and uncivilized." Di Tiro puts the
overall strength of separatist forces operating in Aceh at around 5,000. Asked
what sort of message would he send to a new Indonesian government, perhaps
one headed by Megawati Sukarnoputri whose party won the largest number of
votes in June's parliamentary elections, Di Tiro says: "No message. They're all
the same. Uneducated fools." The REVIEW obtained the interview amid mounting
concern that Aceh may be posing a serious challenge to Indonesian unity. The
REVIEW reports Indonesian military concerns that outside support makes Aceh's
rebels much more dangerous than the ragtag, poorly armed independence fighters
of East Timor and Irian Jaya. Two battalions of troops--backed by 1,700
paramilitary police from Jakarta--have renewed operations in Aceh response to a
wave of ambushes, assassinations and arson attacks in recent weeks. In one of
the worst incidents so far, guerrillas killed five soldiers and wounded 20 in a
July 19 ambush on a military convoy. More than 70,000 refugees have scattered
across Aceh.

Nobel Fever: Secrecy, speculation surrounded prizes
STOCKHOLM (AP): A Finn who helped mediate peace in Indonesia is tipped to win
this year's Nobel Peace Prize, while bookmakers favor a Turkish novelist for
the literature award.
But in the hyper-secretive world of the panels that have spent much of the year
sifting through hundreds of nominations, it's all a guessing game until the
announcements start tumbling out onMonday.
Nobel-watchers rely on complex mathematical formulas, statistical calculations
and pure instinct to make their predictions, but don't get any hints whatsoever
from the awarding institutions in Stockholm and Oslo.
The prizes established 111 years ago by Alfred Nobel, the Swedish inventor of
dynamite, are in the categories of literature, peace, medicine, physics,
chemistry and economics.
The latter, many of whose past winners are Americans, is technically not a
Nobel but a 1968 creation of Sweden's central bank.
Winners get a check of 10 million kronor (US$1.37 million), handshakes with
Scandinavian royalty, and a banquet on Dec. 10 - the anniversary of Nobel's
death in 1896. All prizes are handed out in Stockholm except for the peace
prize, which is presentedin Oslo.
Nobel's instructions were to give the peace prize "to the person who shall have
done the most or the best work for fraternity between nations, for the
abolition or reduction of standing armies and for the holding and promotion of
peace congresses."
This year speculation is focused on the Aug. 15, 2005 peace agreement that
ended 29 years of fighting between Indonesia's government and separatist rebels
in Aceh province, on the Indonesian island of Sumatra.
Betting agency Centrebet of Australia has former Finnish President Martti
Ahtisaari, the mediator of that accord, as the favorite, followed by Indonesian
President Susilo Bambang Yudhoyono and the rebels' Free Aceh Movement.
A tradition of honoring both sides seeking peace means an Aceh prize would
probably be shared. (**)
