São 173 (AFAIK) patentes que a IBM diz que eles violam, duas das quais
estão na lista de patentes que a IBM prometeu não usar. Eu tenho
certeza de que a ação se sustenta com as outras 171.

E, cá pra nós, eu gosto do Hercules, mas eu sei que quando eu concordo
com os termos da licença do zOS e ganho a permissão de usá-lo, eu
estou ciente de que só tenho permissão de usá-lo em hardware zSeries.
Quando eu brinquei com o Hercules, sempre foi com os sistemas
operacionais mais antigos.

Era muito otimismo da TurboHercules querer basear seu modelo de
negócios em uma ambiguidade da licença do zOS. Eles poderiam tentar
ganhar dinheiro de muitas outras formas que não pisassem no calo de
uma empresa que tem mais advogados do que eles tem clientes. Na
verdade, a lista que a IBM anexou deve ter mais patentes do que a
TurboHercules tem clientes.

E esse otimismo - não sem uma certa medida de ganância - custou a
todos nós o Hercules.

Vou lamentar profundamente se o emulador sumir, mas a IBM tem lá sua
razão nesse imbroglio.
