This is an UPDATE as of the latest events concerning Vern Brewer with the help of several others of JUSTICE CANADA trying to perfect an Appeal of The Honourable Judge Delong's decision in the Provincial Court of Alberta, dismissing the Crown's charge of 'Failing to File' a tax return against Mr. McElheran.
 
JUSTICE CANADA called upon two investigative members of the local RCMP MAJOR DRUG SQUAD to perfect service upon Mr. McElheran of the "NOTICE OF APPEAL" to The Court of Queen's Bench scheduled for hearing on April 6th, 2001. This "service" by the RCMP took up several hours to perform which caused other Drug Investigations to wait.
 
Shortly thereafter, another RCMP member arrives at my home. He shows his badge and perfects personal service upon my wife the "MEMORANDUM OF ARGUMENT OF THE APPELLANT".  The cover letter to this package states it is served "By Process Server". Sorry folks if I'm just a little confused - RCMP and Process Server the same thing?????
 
Last Thursday, March 15th, and I might also add, I'm getting ready for the Appeal, Mr. Brewer's Office calls to say that they suddenly realized that their paper work is missing all the documents  required according to The Rules of Court concerning Appeals and asked if I would consent to give Mr. Brewer more time to get it right as they have run out of time to file correct with the court. I said "No".
 
So the Appeal scheduled for April 6th isn't going to happen. We will now be in court to discuss why Mr. Brewer of JUSTICE CANADA was unable to file properly and hear his compelling reasons for having the Court grant him more time. Mr. Brewer may also have to explain to the Court WHY the Crown Prosecutor, Mr. John P. Petch is not doing the Appeal.
 
To date, there has been a volume of letters sent to the Minister of Justice Anne McLellan, the RCMP and to Mr. Vern Brewer, by good and conscientious people concerned with Mr. Brewer utilizing the DRUG SQUAD of the RCMP which delayed other drug investigations, had to carry out Mr. Brewer's good idea to serve Mr. McElheran his "NOTICE OF APPEAL" and at the end of the day Mr. Brewer wasn't aware of the documents which had to be filed with the Court for his Appeal, ran out of time, botching the whole process.
 
Let us not forget the comment made by the Public Relations Officer for the Calgary Tax Service Office to the "A" Channel News Media broadcasting to all of Calgary and beyond that Mr. McElheran is "gumming up the system".  
 
As I'm sure that the Media will forget about April 6th, at The Court of Queen's Bench, the events which take place on that day will be UPDATED...fairly.
